| Stoning punishment has yet to included in the Qanun Jinayat |

WASPADA ONLINE BANDA ACEH – The Banda Aceh IAIN Ar-Raniry Islam expert, Al Yasa’ Abubakar, told that the stoning law cannot be included to Qanun Jinayat yet because it still required a throughout academic research. ”I think the stoning law has to wait to be included in the Qanun Jinayat because it’s not sufficient yet and still needs material extending on the law,” he said here Monday (Nov.16). It was hoped that the Qanun Jinayat that have been approved by the Aceh House Assembly (DPRA) 2004 – 2009 should be revoked because it already stated the stoning law. Abubakar said that the qanun draft didn’t include the stoning law, but it was there when the qanun has been approved. This later caused trouble because Aceh governor, Irwandi Yusuf, has denied to signing the qanun therefore it couldn’t be implemented yet. So, he said, the Qanun Jinayat which has been approved by the DPRA was considered flaw due to unilateral addition of new punishment category, and without proper academic review. Even more, this gives the chance to foreign parties about what and how is the stoning punishment, which has potential to harm the battle in implementing the Islam Sharia in Aceh. Abubakar didn’t say that he refuses the stoning subject applied into the Qanun Jinayat, but it just a matter of time until it can be applied because currently there is no detailed explanation on the law. “Maybe after there is a deep discussion between the ulemas in Aceh, then we can put it into the Qanun. But as for now we can’t,” he said. Qanun Jinayat is related to the protection of character, morality and ethic and consisted of ten crimes such as 'khamar' or alcoholic drinks, 'maisir' or gambling, 'khalwat' or hidden relationship affairs, 'ikhtilath' illegal relationship, 'zina' or free sex , 'liwath' homo sexual, 'musahaqah' lesbian/female homo sexual, 'qadzaf' or to accuse people commit free sex, and to rape.
